Employers Claim Payment Delays THR Not There

Jakarta - Indonesian Employers Association (Apindo) asserts to the last limit of today (08/23/2011) or H-7 Lebaran, no members are delaying payments Hari Raya (THR). Employers pay a THR on time in accordance with circular letter the Minister of Manpower and Transmigration.

"I have until now there has been no reports from members who object or delayed Apindo about THR. So far there's no question about THR," said Chairman of Apindo Sofjan Wanandi to detikFinance, Tuesday (08/23/2011)

Sofjan explained since long ago it had sent a letter to its members about the time of payment THR. The members are encouraged to pay THR Apindo before Lebaran H-7 or later than today. "We write to all the members," he said.

Minister of Manpower and Transmigration Muhaimin Iskandar has warned emphatically that the employers for payments to THR implemented in a timely manner, ie no later than 7 days before Hari Raya Idul Fitri.

Based on task force report on the implementation Lebaran Care Employment at the Central Level Manpower Office has received 17 complaints related to THR originating from areas of Jakarta and West Java. All issues of the complaint has been facilitated by the Department of Labor.

"Allowances religious holiday is the right of workers to be paid by employers to their employees. I reiterate that employers provide immediate THR to employees in a timely manner, not later than seven days before Eid (H-7)," Muhaimin said in a written statement .

Muhaimin added in case of difference of views on a bipartite THR can be discussed between the worker / laborer with company management. When things happen that hurt, the workers / laborers and the public can complain about the problem to the manpower agencies in the area or report it to the Command Post THR Manpower.

"We prioritize the handling of problems and THR through bipartite dialogue process. Do not let differences of opinion and demands THR resulted in disruption of production processes in companies that ultimately detrimental to both sides," he said.

Muhaimin added that the difficulties associated with the company paying THR, there are two ways of settlement, which is resolved through local labor offices, and forwarded to Manpower and if it can not be resolved in the area.

"In principle, companies still must pay THR workers. If trouble should be postponed, but can not escape the obligation to pay," she exclaimed.

THR matter governed by the provisions of Regulation of the Minister of Manpower and Transmigration (Permenakertrans) No.PER.04/MEN/1994 on Religious Feast Benefits For Workers in the Company. Regulation of the Minister of Labor, requires employers to give fatherly THR Religious workers / laborers who have had years of service 3 (three) months or more continuously.

THR Religious given once a year by the employers and the payment adjusted Religious Feast respectively. Workers / laborers who work bermasa 12 months continuously or more receive a minimum of one month salary THR.

While the workers / laborers who work bermasa three months continuously but less than 12 months, have proportionally, ie by calculating the period of work in progress divided by 12 (twelve) months, multiplied by one month of wages.
